How we have obtained your data

Obtained directly from the data subject: If you are a current or potential customer, or simply a user of our website, you provided this data to us yourself, whether offline or online, when requesting our services in order to maintain a contractual relationship with you, or when contacting us to request information, or, for example, if you visited our offices or plant, you provided it by accessing our facilities as a visitor. Your data may also have been passed on to us, where applicable, by our sales network after you provided it to one of our sales representatives. The categories of data we process are: identification data; postal or email addresses; commercial information; and financial data. We do not process special categories of data..

When you provide us with your personal data, you guarantee that you are authorized to provide this information and that it is true, accurate, up to date and not confidential, that it does not violate any contractual restriction or third-party rights, and you undertake not to impersonate other Users.

Obtained automatically when you visit our website: If you have provided data to us through this website, we collect information, for example, when you access the page, fill in any form with personal data, or when you contact us directly by email.

When you visit our website, data is sent from your browser to our server in order to optimize our services and improve your user experience — for example when you access the page or log in to our Services through third-party services such as social networks or Google. This data may be collected and stored automatically by us or by third parties on our behalf. This data may include:

  • the user’s IP address
  • the date and time of the visit
  • the URL of the site the user came from
  • the pages visited on our website
  • information about the browser used (browser type and version, operating system, etc.).

We may process and record such usage, sessions and related information, either independently or with the help of third-party services, including through the use of “cookies” and other tracking technologies such as flash cookies and web analytics.

Our website has social media connectors. When you choose to interact with us through a social network, we cannot be held responsible for the privacy settings chosen by the user; the social network may report your IP address or which page you are visiting on our Website, and it may set a cookie to allow it to function correctly. For example, your name will appear on any “likes” you give or comments you make on our page on a social network. If you do not want your personal data to appear associated with those “likes” or comments, adjust your privacy settings to prevent this — for example, by using a nickname or alias that does not reveal your first and last name.

If you are logged into one of these social networks during your visit to our website, the social network may add that information to your profile, and that information will be transferred to the social network. If you do not want this data transfer to take place, log out of the social network before entering our websites or mobile apps, since it is not within our power to influence this data collection and transfer through social connectors.

If the user, through our official page on a social network, decides to publish and/or share text, photos, videos or other information and/or content, they are solely responsible for ensuring that such content complies with applicable legal regulations. We remind you that, with regard to other people’s data, you must respect their privacy and take particular care when communicating or publishing their personal data. Only the data subject may authorize the processing of their own personal data. Users may only publish, on this page or on our official social media page, personal data, photographs, information or other content that they own or for which they hold third-party authorization. If you provide or publish third-party data, it is your responsibility to obtain their prior, express consent to use it, share it with us and publish it, and it is your responsibility to inform them of our processing of their data or of your publication of it. Publishing third-party data without their consent may infringe, in addition to data protection regulations, their right to honor, privacy or personal image.

In any case, we may remove, both from this website and from our social media pages, any content published by the user when we detect that the user has breached applicable law or the provisions of this privacy policy.

Social networks are not hosted directly on our Services. Your interactions with them are governed by their own policies, not ours. Please read the privacy policies of those social networks for detailed information on the collection and transfer of personal data, your rights, and how to configure your privacy settings.

Third-party data

With regard to other people’s data, you must respect their privacy, taking particular care when publishing their personal data. We remind you that, as a user, you may only provide and consent to the processing of your own personal data, not that of third parties, and that if you provide us with third-party data you are making a transfer of personal data; it is your responsibility to obtain the prior, express consent of those third parties to use it and provide it to us, and you are responsible for informing them that their data has been included in our records.

Publishing third-party data without their consent may infringe, in addition to data protection regulations, the right to honor, privacy or personal image of those third parties — rights whose protection is governed by Spanish Organic Law 1/1982, of 5 May, on the civil protection of the right to honor, personal and family privacy, and personal image.

Purpose

The data you provide us through the contact form (name, company, email address and telephone number) is processed for the following purposes:

  • To handle your request for information and manage our communication with you.
Legal basis: legitimate interest of the controller or performance of pre-contractual measures.
  • To send you, if you expressly authorize us to do so, commercial information about our products and services.

The installation of technical cookies necessary for the website to function is carried out without the need for prior consent. Analytical or non-technical cookies are only installed following prior acceptance.

Legal basis: consent.

Retention period

We will keep the personal data you provide us for as long as you do not request its deletion. Even after such a request, we may retain it, with processing limited, for as long as necessary solely to comply with the legal/contractual obligations to which we are subject and/or during the legal periods established for the statute of limitations on any liability on our part and/or for the exercise or defense of claims arising from our relationship with the data subject.

Recipients

We inform you that the data you provide us may be disclosed to third-party entities for purposes directly related to the legitimate functions of discloser and recipient, such as:

  • To transport companies responsible for the logistics of shipping and delivering our goods.
  • To banking institutions for the management of collections and payments.
  • To entities or bodies to which there is a legal obligation to disclose data (Tax Administration, etc.).
  • To insurance companies for the management and coverage of commercial risks.
  • To our subsidiaries in other countries, or to the agents or distributors in our sales network, we will pass on inquiries received through our website that need to be handled by them. Where this involves an international transfer of data to a country outside the European Economic Area, the data subject gives unambiguous consent to that transfer by providing their data.

INTERNATIONAL TRANSFERS

We will endeavor to ensure that personal data is always processed and located within the European Economic Area. However, in certain circumstances we may carry out international data transfers — for example, where necessary for the conclusion or performance of a contract, in the interest of the data subject, between HORUS DATA SOLUTIONS, S.L.U. and another natural or legal person; or where necessary for the performance of a contract between the data subject and HORUS DATA SOLUTIONS, S.L.U., for example when using service providers located outside the European Union who may have access to personal data in order to provide services ancillary to our business (hosting, housing, SaaS, remote backups, IT support or maintenance services, email management, sending emails and email marketing, file transfer, etc.), or for carrying out pre-contractual measures adopted at the request of the data subject.

These entities may vary over time; however, we will strive to select entities that either belong to countries with a level of data protection equivalent to that of Europe, or that have appropriate safeguards in place to achieve that level, or the transfer will be carried out on the basis of one of the exceptions provided for that purpose under the GDPR.

Rights

Where applicable, you may exercise your rights of access, rectification, erasure, restriction and objection to processing, as well as the right not to be subject to decisions based solely on automated processing of your data, at the postal or email address indicated at the beginning of this privacy policy; in both cases by means of a signed, written request accompanied by a copy of your national ID card, passport or other valid identification document. If your data changes, you must notify us at the same address; this company accepts no liability if you fail to do so.

Right of access: You can ask us what personal data we are processing and even request a copy of it.
Right of rectification: You can ask us to correct inaccurate personal data or to complete incomplete data, including by means of a supplementary statement.
Right of erasure (right to be forgotten): You can ask us to delete your personal data when: it is no longer necessary for the purposes for which it was collected, you withdraw your consent, it has been processed unlawfully, or to comply with a legal obligation.
Right to restriction of processing: You can ask us to restrict the processing of your data, in which case we will only retain it for the exercise or defense of claims.
Right to object: You can object to the processing of your data if such processing is based on the legitimate interest of the data controller or is carried out for advertising purposes.

Once we have received any of the above requests, we will respond within the legally established time limits. You can file a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos). For more information about the rights you can exercise, and to request sample forms for exercising them, you can visit the Spanish Data Protection Agency’s website at www.aepd.es.
